Live Free Or Die! Oops…

Weare, New Hampshire (PRWEB) Could a hotel be built on the land owned by Supreme Court Justice David H. Souter? A new ruling by the Supreme Court which was supported by Justice Souter himself itself might allow it. A private developer is seeking to use this very law to build a hotel on Souter’s land.

Justice Souter’s vote in the “Kelo vs. City of New London” decision allows city governments to take land from one private owner and give it to another if the government will generate greater tax revenue or other economic benefits when the land is developed by the new owner.

On Monday June 27, Logan Darrow Clements, faxed a request to Chip Meany the code enforcement officer of the Towne of Weare, New Hampshire seeking to start the application process to build a hotel on 34 Cilley Hill Road. This is the present location of Mr. Souter’s home.

Clements, CEO of Freestar Media, LLC, points out that the City of Weare will certainly gain greater tax revenue and economic benefits with a hotel on 34 Cilley Hill Road than allowing Mr. Souter to own the land.

The proposed development, called “The Lost Liberty Hotel” will feature the “Just Desserts Café” and include a museum, open to the public, featuring a permanent exhibit on the loss of freedom in America. Instead of a Gideon’s Bible each guest will receive a free copy of Ayn Rand’s novel “Atlas Shrugged.”

Clements indicated that the hotel must be built on this particular piece of land because it is a unique site being the home of someone largely responsible for destroying property rights for all Americans.

“This is not a prank” said Clements, “The Towne of Weare has five people on the Board of Selectmen. If three of them vote to use the power of eminent domain to take this land from Mr. Souter we can begin our hotel development.”

Clements’ plan is to raise investment capital from wealthy pro-liberty investors and draw up architectural plans. These plans would then be used to raise investment capital for the project. Clements hopes that regular customers of the hotel might include supporters of the Institute For Justice and participants in the Free State Project among others.

    I don’t know which side gets madder about this issue, liberal or conservative, liberals hate the idea that wal-mart might be able to condem their property and conservaties just hate the idea.

    This is an issue that the free market should take care of. If a piece of property is so valuable that you have to have it, eventually you will pay enough that the person will sell it to you.

    I guess the problem comes in when you have blighted areas that no one really wants, and the municipality wants to improve the area, so they condem all the rent by the hour motels and put in new businesses. Then of course the people who like the rent by the hour motels are upset.

    Maybe this issue is not as black and white as people think, although since it seems to be a rare case of agreement between liberals and conservatives maybe it is wise to leave it alone.

    Nice work, I like how you call the homes that the poor have worked so hard to buy hourly-rate motels implying the presence of rampant prostitution.

    These are homes, not businesses but homes, private dwellings owned by people. I always thought that gun control would be the beginning of the end for America but the liberals have done one better, they just take the home where your gun is.

    I’m curious about the gray area you see in this.

    Second, their are areas that probably need to be condemed and generally the people who own the condemed proerty are well compensated so they can buy another house or business.

    The gray are for me comes in cases where you have viable businesses that are being condemed because the city thinks that their are better uses for that property. In this cases it seems like it is best to let the free market decide, like I said earlier, if a large company wants the property, maybe they can make the existing owner an offer they cannot refuse.

    I am sure their are some cases where cities need to have the ability to condem property, but doing it solely to increase their tax base seems like a problem.

    I might agree with you on this one, I am going to seek therapy

    I think this might be funny except I don’t see where the connection is to a rent bth motel back east and my business here in Las Vegas. This probably is a good joke, please clarify.

    Oh, you think so, do you? Why are you so sure that business will pay someone well when all you have to do is have the city steal it from the rightful owner and charge the replacement value of the home. In Vegas, a typical 2000 sq ft home sells for about $450,000 baut can be replaced, if destroyed, for about $180,000. Since there is no market of bidders for the property the value is determined by the gov’t, the same ones who are stealing it.

    if a large company wants the property, maybe they can make the existing owner an offer they cannot refuse.

    But why? Now, you can have the city steal the land and pay them the assessed value, which is much lower than market value in most cases. Why pay a premium when you can get the same thing at discount?

    I am sure their are some cases where cities need to have the ability to condem property, but doing it solely to increase their tax base seems like a problem.

    Vegas does this often with out of state slumlords who allow their properties to house prostitution and drug manufacturing facilities.

    I know this is drawing the ire of many – and I’m not happy about it myself, but the requirements that need to be met for someone’s property to be repossessed are pretty strict. Also, the local backlash when this takes place could persuade politicans against using it. The most important thing to remember though, is that a company has to be willing to move there in the first place, and most of the depressed regions of the country are like that for specific reasons.

    I’m very curious to see how many times this law is used in the upcoming years – for what companies and what the results end up being.

    It’s not right, but with the luxury of observing from a distance – seeing how many Americans this affects and the circumstances will be very interesting to see.

    The niehborhood would probably gentrify on its own; so why takeover these businesses? Sometimes it is better to just let evolution take its course.

    The more I try to figure out ways to defend this the harder it gets.

    I see all these stories about the ‘shame’ method of dealing with prostitution – posting the faces of johns before they’re even convicted, coupled with the policies of the Bush administration (anti birth control/no needle exchange), it’s not going to get better before it gets worse.

    On this issue…I look for wisdom to the societies that came before us, and in Europe they have the prostitution segregated in specific areas – mandated testing for STDs, mandated birth control, etc. Better yet, tax revenue is gained as opposed to what we here in America get from it…the spread of AIDS, pimps, drugs, etc.

    I’m quite sure prostitution has been a problem since the dawn of time…how we deal with it is pretty stupid. Most boring episodes of Cops are the vice episodes. Give me a drunken domestic disturbance, footchase or drug warrant being served any day over that.
